1. Overview and Safe Harbor Statement
Street Gusto LLC ("Street Gusto", "we", "us", or "our") respects the intellectual property rights of others and expects users of our platform to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act of 1998 (DMCA), 17 U.S.C. § 512.
Street Gusto operates as an online service provider that hosts user-uploaded content, including photographs uploaded by commissary operators in connection with their listings on streetgusto.com. Street Gusto qualifies for the safe harbor protections of 17 U.S.C. § 512(c) as a provider of online storage at the direction of users, provided it complies with the notice-and-takedown procedures described in this policy.
This page describes our procedure for receiving and responding to copyright infringement notices, our counter-notification process, and our repeat infringer policy. If you believe that content hosted on streetgusto.com infringes your copyright, please follow the procedure described in Section 3 below.
2. Designated Copyright Agent
Street Gusto has designated the following agent to receive notifications of claimed copyright infringement pursuant to 17 U.S.C. § 512(c)(2). Our designated agent has been registered with the U.S. Copyright Office in accordance with 17 C.F.R. § 201.38.

Notices sent to any address other than the designated agent address above may not receive a timely response. We strongly recommend sending takedown notices by email for the fastest processing.
3. How to Submit a DMCA Takedown Notice
To be valid under 17 U.S.C. § 512(c)(3), a written notification of claimed infringement must include all six of the following elements. Incomplete notices will not be acted upon.

Identification of the copyrighted work claimed to be infringed.
If multiple copyrighted works are covered by a single notification, provide a representative list.

Identification of the material that is claimed to be infringing and that is to be removed or disabled.
Include enough information — such as the full URL of the specific page where the content appears — to allow us to locate the material.

Your contact information.
Provide your name, mailing address, telephone number, and email address.

A statement that you have a good-faith belief that the use of the material is not authorized.
Include this exact language: "I have a good-faith belief that the use of the material described above is not authorized by the copyright owner, its agent, or the law."

A statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner.
Include this exact language: "I declare, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the copyright owner."

Your physical or electronic signature.
A typed name at the bottom of an email constitutes an electronic signature.

4. Our Response to Valid Takedown Notices
Upon receipt of a complete and valid takedown notice we will:
- Acknowledge receipt of your notice within two (2) business days.
- Remove or disable access to the allegedly infringing material expeditiously.
- Notify the user who uploaded the material that it has been removed and provide a copy of your notice (with your personal contact information redacted as appropriate).
- Inform the user of their right to file a counter-notification.
- Document the removal for our legal records.
If a notice is materially incomplete, we will notify you of the deficiency and you may resubmit a corrected notice.
5. Counter-Notification Procedure
If you are the user whose content was removed and you believe your content was removed in error or that you have the right to post the content, you may file a counter-notification under 17 U.S.C. § 512(g)(3). A valid counter-notification must include all four of the following elements:

Identification of the material that was removed and the location where it appeared before removal.
Include the URL of the page where the content appeared.

A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
Include this language: "I swear, under penalty of perjury, that I have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."

Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court.
Include: "I consent to the jurisdiction of the federal district court for the judicial district in which my address is located (or, if outside the United States, any judicial district in which Street Gusto LLC may be found), and I will accept service of process from the person who provided the original takedown notice or an agent of such person."

What Happens After We Receive a Counter-Notification
We will forward the counter-notification to the original complaining party. If the complaining party does not notify us within 10 to 14 business days that they have filed an action seeking a court order to restrain the allegedly infringing activity, we will restore the removed material or cease disabling access to it. We are not required to restore material if the original notice was legally sufficient and a court order has been sought.

6. Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i)(1)(A), it is the policy of Street Gusto to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright. We maintain records of all valid DMCA takedown notices received. Users who are the subject of two (2) or more valid, non-reversed takedown notices may have their accounts suspended or permanently terminated at our sole discretion.
A takedown notice is considered "reversed" if the complaining party fails to initiate legal proceedings within the counter-notification response window, or if a court of competent jurisdiction rules in the user's favor.
7. Misrepresentation Warning
Important Legal Warning
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees.
Only submit a DMCA notice if you have a good-faith belief that the identified material infringes your copyright. Do not use DMCA takedown notices as a mechanism to suppress criticism, satire, or legally protected speech.
8. General Copyright Policy
Street Gusto prohibits users from uploading, posting, or otherwise transmitting any content that infringes the copyrights or other intellectual property rights of any person or entity. By uploading content to our platform, you represent and warrant that:
- You are the copyright owner of the content, or you have obtained all necessary licenses and permissions to upload and display the content on our platform.
- The content does not infringe upon the copyright, trademark, privacy, publicity, or other legal rights of any person or entity.
- You will not upload photographs taken by professional photographers without their written consent.
- You will not upload stock photography or licensed images unless you possess an appropriate commercial license permitting public display on third-party platforms.
Our platform employs automated content moderation tools (including AI-based image analysis and SafeSearch filtering) to detect certain categories of prohibited content. These tools are not a substitute for your legal obligations as the uploader, and their approval of an upload does not constitute a finding that the content is free of copyright infringement.
