1. Agreement to Terms

By accessing and using Street Gusto ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your use of our website located at streetgusto.com (the "Service") operated by Street Gusto ("us", "we", or "our").

2. Use License

Permission is granted to access and use the Street Gusto Service for personal or commercial purposes. This is the grant of a license, not a transfer of title, and under this license you may not:

• modify, copy, reproduce, or create derivative works of the materials (except for Content you own)
• redistribute, republish, or publicly display the materials without our prior written permission
• attempt to reverse engineer any software contained on the website
• remove any copyright or other proprietary notations from the materials

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. User Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.

By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service.

You retain any and all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights.

5. Copyright & DMCA Policy

Street Gusto operates under the safe harbor provisions of the Digital Millennium Copyright Act of 1998 (DMCA), 17 U.S.C. § 512. We respect the intellectual property rights of others and require all users to do the same. We have designated a registered DMCA Agent with the U.S. Copyright Office (Registration No. DMCA-1070624, effective March 14, 2026).

Ownership Warranty

By uploading any content (photographs, logos, descriptions, or other materials) to our platform, you represent and warrant that:

• You are the original creator and sole copyright owner of the content, or
• You hold a valid, current license that explicitly permits public display on third-party platforms, and
• Your upload does not infringe the copyright, trademark, right of publicity, or any other intellectual property right of any person or entity.

You may not upload:

• Photographs taken by professional photographers without their written consent.
• Stock photography or licensed images unless your license explicitly permits public display on third-party platforms.
• Screen captures, reproductions, or derivative works of any third-party copyrighted content.
• Any content that infringes the copyright, trademark, or other intellectual property rights of any person or entity.

Automated Screening Disclaimer

Our automated content moderation systems (AI analysis, SafeSearch, antivirus scanning) help screen uploads for certain prohibited content, but these tools are not a substitute for your legal obligations. Automated approval of an upload does not constitute a determination that the content is free of copyright infringement.

DMCA Takedown Procedure

If you believe that content on streetgusto.com infringes your copyright, you may submit a takedown notice to our designated DMCA agent. Upon receipt of a valid, complete notice we will:

1. Acknowledge receipt within 2 business days.
2. Review and, if the notice is valid, remove or disable access to the content expeditiously (typically within 1–3 business days of validation).
3. Notify the content uploader that their material has been removed and provide them with the notice.
4. Maintain a written record of the notice and all actions taken in our compliance database.

Counter-Notification

If you believe your content was removed as a result of mistake or misidentification, you may submit a counter-notification pursuant to 17 U.S.C. § 512(g)(3). If a valid counter-notice is received and the original claimant does not file a court action within 10–14 business days, we will restore the content. Repeat Infringer Policy

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright, in accordance with 17 U.S.C. § 512(i)(1)(A). Users who accumulate two (2) or more valid, non-reversed DMCA takedown notices against their uploaded content may have their accounts suspended or permanently terminated at our sole discretion. All valid notices are logged in our compliance system and associated with the responsible user account.

Misrepresentation Warning

Pursuant to 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys' fees. Street Gusto reserves the right to seek damages from any party who submits a fraudulent DMCA notice or counter-notice.

You may not use our Service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To spam, phish, pharm, pretext, spider, crawl, or scrape
• For any obscene or immoral purpose

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

12. Governing Law

These Terms shall be interpreted and governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
